APPLICANT REQUESTS THAT:
His Duty Title of Bioenvironmental Engineer on his six officer Performance Reports (OPR), covering the period Sep 99 through Sep 04, be changed to read Bioenvironmental Engineering Flight Commander.
RESUME OF CASE:
On 25 May 11, the Board considered and denied the applicants original request to make the same corrections to his records. In the original case, the applicant contended that during the period of time in question, his key duties, tasks and responsibilities, as reflected in Part III, Block 2, of his OPRs support that his duties were in line with having the title Flight Commander. The Board concurred with the recommendation of ARPC/DPTS to deny relief, noting that the individuals providing statements in support of the applicant did not appear to be Commanders with the authority to award the required change. For an accounting of the facts and circumstances surrounding the applicants original request and the rationale of the earlier decision by the Board, see the Record of Proceedings (ROP) at Exhibit F.
On 23 Sep 13, the applicant submitted a request for reconsideration of his original request and provided a letter of support written by the applicants rater on each of the OPRs in question and who was also his medical group commander in 2004. The applicants complete submission, with attachments, is at Exhibit G.
THE BOARD CONCLUDES THAT:
We thoroughly reviewed the evidence of record and considered the weight and relevance of the additional documentation provided by the applicant and determined that sufficient relevant evidence has been presented to demonstrate the existence of an injustice. While the Board notes the comment from ARPC/DPTS that the statements of support in the applicants original case did not appear to be from Commanders with the authority to award the requested duty title change, and the applicant has now provided a supporting statement from his rater of record and medical group commander during the events in question, we believe the preponderance of the evidence indicates that corrective action is warranted. While we note the applicant has not presented any evidence to indicate that his original duty title was erroneous, we believe that because the applicant has provided evidence indicating that said duty title would serve to harm his future promotion opportunities since his transition from the Air National Guard to the Regular Air Force, and the evidence of record also indicates that the requested duty title, Bioenvironmental Engineering Flight Commander, accurately describes the applicants duties during the events under review, we believe it would be in the interest of justice to correct the records as indicated below.
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his duty title, as reflected on the officer performance reports (OPR) closing 11 Sep 99, 11 Sep 00, 11 Sep 01, 11 Sep 02, 11 Sep 03, and 11 Sep 04, was Bioenvironmental Engineering Flight Commander, instead of Bioenvironmental Engineer.
